Legal Nature of This Document

This Terms & Conditions document (“Terms”) is a computer-generated electronic record published in accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (as amended). This document does not require any physical or digital signature.

These Terms constitute a legally binding agreement between you (“User”, “You”, “Your”) and NestWise Consulting LLP, a limited liability partnership registered under the Limited Liability Partnership Act, 2008, operating the platform Maynaa (“Maynaa”, “NestWise”, “We”, “Us”, “Our”).

By accessing, browsing, or using the Maynaa platform, website, or services, you acknowledge that you have read, understood, and agreed to be bound by these Terms.

About Maynaa & NestWise Consulting LLP

Maynaa is a brand and platform operated by NestWise Consulting LLP.

NestWise Consulting LLP is a real estate consulting firm that assists homebuyers and property buyers by:

  • Conducting property due diligence
  • Legal and title verification
  • Promoter background checks
  • Property background verification
  • Development Plan (DP) checks
  • Connectivity and infrastructure analysis

NestWise delivers a comprehensive property due diligence report to buyers and may also suggest Maynaa-verified properties based on buyer requirements.

Nature of Engagement (Important Disclaimer)

The Due Diligence Report (“Report”) prepared and delivered through Maynaa is a property research and assessment service only.

NestWise Consulting LLP does not provide legal, financial, tax, valuation, or investment advice, and nothing contained in the Report shall be construed as a legal opinion, certification, guarantee, or recommendation.

Basis of Information & Scope Limitation

The Report is prepared based on:

  • Publicly available records
  • Documents made available at the time of review
  • Limited factual verification and professional observations

NestWise Consulting LLP does not independently verify or warrant the accuracy, completeness, or future validity of third-party, governmental, or external data. All observations are provided on an “as-is” basis as of the report date.

No Liability & LLP Protection

In accordance with the Limited Liability Partnership Act, 2008:

  • Any liability shall be limited strictly to NestWise Consulting LLP
  • No partner, designated partner, employee, or associate shall be personally liable

NestWise Consulting LLP shall not be responsible for any direct or indirect loss, damages, disputes, delays, regulatory actions, or financial consequences arising from reliance on the Report or decisions taken by the User.

Client Responsibility

All decisions relating to:

  • Property purchase
  • Negotiation
  • Investment
  • Transaction execution

rest solely with the User.

Users are strongly advised to conduct independent verification and consult qualified legal and financial professionals before entering into any binding agreement.

Confidentiality & Restricted Use

The Report is strictly confidential and intended solely for the User's personal and internal use.

Without prior written consent from NestWise Consulting LLP, the User shall not:

  • Share, circulate, reproduce, publish, or distribute the Report (in full or part)
  • Disclose contents to developers, brokers, builders, agents, media, forums, or third parties
  • Use the Report for litigation, publicity, negotiation leverage, or commercial purposes

Breach & Legal Consequences

Any unauthorized sharing, reproduction, or misuse of the Report constitutes a material breach and may attract civil and legal action under applicable Indian laws. NestWise Consulting LLP reserves the right to seek injunctive relief and damages.

Acceptance of Terms

By accessing, purchasing, or using the Maynaa platform or Report, the User confirms acceptance of these Terms and acknowledges that NestWise Consulting LLP acts solely as an independent research consultant and is not a party to any real estate transaction.

Payments

  • All payments are processed through authorized payment gateways (including Cashfree).
  • Payments must be made in full prior to service initiation unless agreed otherwise in writing.
  • NestWise Consulting LLP is not responsible for payment failures caused by banks or payment gateways.

Cancellation & Refund Policy

Refund Eligibility

  • Cancellation within 24 hours of report submission qualifies for a refund.
  • No refund shall be issued once the report or service has been delivered, accessed, or used.

Refund Processing

  • Approved refunds will be credited to the original source account.
  • Refunds are processed within 7 working days or as per the recipient bank's timeline.

Non-Refundable Cases

  • Delivered reports or completed services
  • Delays caused by incomplete, incorrect, or delayed information provided by the User

Intellectual Property

All content, reports, formats, trademarks, logos, brand names, and platform materials related to Maynaa and NestWise Consulting LLP are proprietary and protected under applicable intellectual property laws. Unauthorized use is strictly prohibited.

Limitation of Liability

To the maximum extent permitted by law, NestWise Consulting LLP shall not be liable for indirect, incidental, consequential, or punitive damages.

Total liability, if any, shall not exceed the amount paid by the User for the specific service.

Modification of Terms

NestWise Consulting LLP reserves the right to modify or update these Terms at any time. Updated Terms will be effective immediately upon publication on the platform. Continued use constitutes acceptance.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India.

Courts at Pune, Maharashtra, shall have exclusive jurisdiction.
